    B Sınıfı sürücü belgesiyle motosiklet kullanmadan dolayı trafik suç tutanağı düzenlendi ve 39/1-a maddesine göre mahkemeye sevk edildi. Verilen kararı aynen yazıyorum:
    Adı geçenin eylemine uyan 2918 sayılı KTK'unun 39/1-a-son maddesi yollamasıyla aynı kanunun 36/3.fıkra 1.cümlesinde öngörülen 1 ay hafif hapis cezasının TCK'nun 52.maddesi gereğince günlüğü taktiren 25YTL hesabıyla paraya çevrilerek 750YTL idari para cecası ile cezalandırılmasına...
    Adı geçen kanunu incelediğimde 36/3'ün ehliyetsiz araç kullanmak olduğu yazıyor. Ben ise yetersiz ehliyetle araç kullanmaktan sevk edildim. Kanunun karşılığı 237YTL adli para cezası olacağı yazıyor. Benim asıl tabi olduğum ceza maddesi ne? 39/1a'mı yoksa hiç ehliyeti olmayanlara verilen ceza maddesi olan 36/3'mü?

    Yasada suçun tanımı her ne kadar ayrı ayrı ise de:

    1- Sürüvü belgesiz araç kullanmak
    2- Sürücü belgesiyle yetki verilmemiş aracları kullanmak

    her ikisinin de müeyyidesi aynıdır. Yani her iki durumda da 36/3 den cezalandırılırsınız. Bu durum 39 maddenin sonunda açıkça yazmaktadır.


    Size uygulanan cezada bir hata görmüyorum. Boşuna itiraç edip masraf etmeyin. Saygılar..

    MADDE 39- Sürücü belgelerine ait esaslar şunlardır;
    a) Araçları kullanma yetkisi;
    1. A1, F, G ve H sürücü belgeleri ile yalnız kendi sınıflarındaki araçlar,
    2. A2 sınıfı sürücü belgesi ile A1,
    3. B sınıfı sürücü belgesi ile F,
    4. C sınıfı sürücü belgesi ile B ve F,
    5. D sınıfı sürücü belgesi ile C, B ve F ,
    6. (Değişik: 17.10.1996-4199/17 md.) E sınıfı sürücü belgesi ile B, C,ve F,
    Sınıfı sürücü belgeleri ile kullanılan araçlar da sürülebilir.
    (Değişik: 17.10.1996-4199/17 md.) E sınıfı sürücü belgesi sahipleri D sınıfı sürücü belgesi ile sürülen araçları kullanabilmeleri için römorklu veya yarı römorklu araçlarla uygulamalı sınava tabi tutulurlar.
    Sürücü belgesi sahiplerinin sürücü belgesinin sınıfına göre sürmeye yetkili oldukları araçların dışındaki araçları sürmeleri yasaktır.
    b) Römork takarak taşıt kullanma;
    B, C ve E sınıfı sürücü belgesi sahipleri, araçlarına en çok yüklü ağırlığı 750 kg’a kadar olan (750 kg. dahil) hafif römork takarak da kullanabilirler.
    Yüklü ağırlığı 750 kg’ı geçen römorkları taşıtlarına takarak kullanmak isterlerse ayrı bir sınavdan geçirilirler ve römorklu taşıt kullanabilecekleri belgelerine işlenir.
    c) (Değişik: 17.10.1996-4199/17 md.) Sürücü belgelerinin geçerlilik süresi:
    Sürücü belgelerinden (K) sınıfı sürücü aday belgesi altı ay geçerlidir. Diğer sürücü belgelerinin İçişleri Bakanlığı’nca, trafik güvenliği nedeniyle, gerekli görüldüğünde değiştirilmesi zorunludur. Ödenmemiş trafik para cezaları kanuni faiziyle birlikte tahsil edilmedikçe değiştirme işlemi yapılmaz. Geçerli bir mazeret olmaksızın altı ay içinde sürücü belgelerini değiştirmeyen sürücüler araç kullanmaktan men edilir. Değiştirme işlemleri İçişleri Bakanlığı’nca çıkarılacak yönetmelikte belirlenecek esas ve usullere göre yapılır.

    (G) Sınıfı sürücü belgesi alacak olanlarda aranacak özel şartlar ile uluslararası sürücü belgelerinin veriliş şartları yönetmelikte gösterilir.

    (Değişik: 25.05.1997-4262/4 md.) Bu madde hükümlerine aykırı hareket eden sürücüler ile bunlara araç kullandıranlar, bu Kanunun 36 ncı maddesinin üçüncü fıkrasına göre cezalandırılırlar.
