User Content Posted on the Site

Copyright Complaints

Termination

The Company may terminate your membership, delete your profile and any content or information that you have posted on the Site or through any Platform Application and/or prohibit you from using or accessing the Service or the Site or any Platform Application (or any portion, aspect or feature of the Service or the Site or any Platform Application) for any reason, or no reason, at any time in its sole discretion, with or without notice, including if it believes that you are under 13, or under 18 and not in high school or college. When we are notified that a user has died, we will generally, but are not obligated to, keep the user's account active under a special memorialized status for a period of time determined by us to allow other users to post and view comments.
Governing Law; Venue and Jurisdiction

Arbitration

The location of the arbitration and the allocation of costs and fees for such arbitration shall be determined in accordance with such AAA Rules and shall be subject to the limitations provided for in the AAA Consumer Rules (for consumer disputes). If such costs are determined to be excessive in a consumer dispute, the Company will be responsible for paying all arbitration fees and arbitrator compensation in excess of what is deemed reasonable. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction.

The Information We Collect

Bir gün grubumuza birisi girdi ve bizi tahrik edecek şekilde eski şirketimizin lehinde sözler söylemeye basladı bizde bu kişinin kim olduğunu sorduk karşılıklı hakaret etik bir birimize .
kim olduğunu açılamayan bu şahış bizi iyce tahrik etti.
Aradabirde kendi aramızda bu kişi kimliğini açıklamıyorsa kesin eski şirketimizin adamı diyede yazılar yazdık bu yazılartlda şirketimizin çalışanlarınıda içine katark hakaretlerde ettik.
Daha sonra bu yazıların eski arkadaşlarımıza değilde o şahsa karşılık yazıldığını belirten yazılar yazdık , eski yazılarımızı sildikve özür yazıları yazdık arkadaşşlara.


Bu olay 1.5 ay önce 1 hafta içinde gelişti.
Daha sonra şirket bizi dava etmiş.1 arkadaşımıza bugun kağıt gelmiş ve 3 ümüzün isim var ve dava bursda.

dava konusu güya şirketin izni olmadan resimler eklenmesi logoların kullanılması ve şirket hakkında yada çalışsanlar hakkında hakaret edilmesi.
10 bin YTL lik bir dava açılmış bize dava 21 temmuzdaymış.

Şimdi daha bana ve diğer arkadaşımın evine tebliğat gelmedi gelirse bu tebliğatı almak zorundamıyım.

Çünkü internet ortamında şuan oyle bir hakaret te yok.Hepsi 1 ay önce yazılmış ve hemende silinmişti.
Daha doğrusu Davacı hakaretten çok logo ve isim kullanımı adına dava açmış.
Ama grubu kuran asıl şahısla konuştuğumda bu logoları kendisi değil başka birisinin yüklediğini söyledi bunu bizde yüklemediydik ama grupdan kim yüklediyse yüklemiş bu resimleri.Acaba bundan yola çıkarak bir sonuç elde edebilirlermi ?
Hatta bu resimleri bizi tahrik eden şahışda yüklemiş olabilir yani bize komploda kurulmuş olabilir biz bunu nasıl kanıtlıyabiliriz ?

Facebooktan bilgi ve belgeler talep edildiginde eski tarihli de olsa bu metinler cikartilip mahkemeye gonderilebilir,teknik olarak bu mumkundur,ancak Facebook mahkemeye boyle bir yanit verir mi o bilinmez,bildigim kadariyla ceza davalarinda dahi bilgi verilmedigi oluyormus.Ancak bu bilgi tamamiyla kulaktan dolma bir bilgidir,o nedenle tam olarak sirketin yanit verip vermeyecegini bilemiyorum.
