Excuse me please that I take Your time,
but I have a problem wich I can solve wit Your assistance before I make
something wrong.
For example there are two companys one is located in Germany and has
the name Apollon-Touristic Gmbh and the domains Appolon.de,appolon.com
and is
selling touristic tours from germany to Greece.
My company is located in Greece
and we have the domain (for example we will take this)
appolonprivate.com and we wil sell also greece over the internet .
So would that be a problem in the future.?
Mayby is seams like a stupied question, but it is important for me to
make it on the wright way.
My appolonprivate will be also a trademark

Dear Sir,
A trademark or common law rights owner may obtain the transfer or
cancellation of a domain name under the Uniform Domain Name Dispute
Resolution Policy (UDRP) when there was abusive registration and use of
the domain name. See http://www.wipo.int/amc/en/domains/gtld/udrp/.
The UDRP procedure is an administrative procedure, it is not a court
procedure.
The UDRP is incorporated into the registration agreement of all
ICANN-accredited registrars and thus any person or entity registering a
gTLD (such as a .com domain name) agrees to submit to the UDRP for
disputes with respect to the domain name they are registering. It is
the registrant's responsibility to ascertain they are not infringing on
third-parties' rights when registering a domain name.
According to Paragraph 4(a) of the UDRP, trademark or service mark
owners can obtain the transfer of the domain name if they establish each
of the following criteria:
(i) the domain name registered by the domain name registrant is
identical or confusingly similar to a trademark or service mark in which
the complainant (the person or entity bringing the complaint) has
rights; and
(ii) the domain name registrant has no rights or legitimate interests
in respect of the domain name in question; and
(iii) the domain name has been registered and is being used in bad
faith.
The UDRP provides a number of examples of the above mentioned criteria
(ii) and (iii) (http://www.wipo.int/amc/en/domains/rules/index.html).
If any of these elements cannot be established, the complaint is denied,
i.e. the domain name remains with the domain holder (respondent).
The Center as an independent and impartial body cannot give any views
about the strengths and weaknesses of a party's case, or provide any
legal assistance outside of general references. However, the Center's
Index of WIPO UDRP Panel Decisions offers easy access for parties to the
legal and other information contained in WIPO decisions.
